The Chief Compliance Officer oversees the Corporate Compliance Program, functioning as an independent and objective body that reviews and evaluates compliance issues/concerns within the organization. The position ensures the Board of Directors, management and employees are in compliance with the rules and regulations of regulatory agencies, that company policies and procedures are being followed.
The Chief Compliance Officer, together with the Corporate Compliance Committee, is authorized to implement all necessary actions to ensure achievement of the objectives of an effective compliance program.
Duties & responsibilities
- The Chief Compliance Officer of the Bank shall be appointed with the recommendation of the Board of supervisors and prior approval of the Central Bank.
- The Chief Compliance Officer shall report to the Board of Supervisor/Compliance Committee (A Sub-Committee of Board of Supervisor) and shall be responsible for ensuring effective implementation of the compliance policy and other compliance initiative, coordinating the identification and management of the bank’s compliance risks and supervising the activities or other Compliance Functionaries.
- The Chief Compliance Officer shall assist the bank’s Top management in managing effectively the compliance risks faced by the Bank and would be responsible for providing clarifications on issues or concerns relating to the Bank’s compliance policy, guiding the compliance risk assessments, compliance risk reviews and compliance monitory and testing programs.
- The Chief compliance Officer shall be responsible for developing and maintaining the Compliance Policy including the approval / reporting of executions thereto, maintaining oversight of the activities of the compliance risk management framework across the Bank.
- Further, the Chief Compliance shall be responsible for maintaining a relationship with the regulators supervising the Bank and act as the key interface between the Top Management of the Bank and regulators.
- The Chief Compliance Officer shall participate in the responsibility in the discussion between the Bank and the DAB if any. He shall also monitor industry-wide developments and provide guidance on strategic and policy matters, as required.
- Ensure that all Compliance Department staffs are kept up to date with new/revised Compliance laws/regulations.
- Ensure Compliance Staff (in conjunction with Training Department) maintain up to date training\ manuals.
- Ensure all Branches staffs are provided with frequent training courses on all aspects of Compliance.
- Maintain excellent daily relations with all relevant Da Afghanistan Bank and Afghanistan Government entities with respect to Compliance issues.
- Oversee day to day operational activity of Compliance Department personnel.
- Evaluate all reports of suspicious/ transactions (including PEPs) and planned reporting requirements (e.g. FIU).
- In conjunction with Risk Department review all operating procedures of the bank annually.
- In conjunction with Risk Department review annually all policy manuals from a Compliance perspective.
- Ensure to have all the reverent regulations, laws instructions are properly followed by the bank, give report for the non-compliance to board.
- Follow up of the every regulatory circular with concerned department.
- Monthly follow up report on the external Audit/ Regulatory Audit observations to board for the updates with the concerned areas/departments.
• Review all daily LCTR reports and report to DAB accordingly.
• Ensure timely update of Blacklists/UN Watch lists etc.
• Foreign Account Tax Compliance Act (FATCA) implementation and reporting to IRS - US on foreign accounts.
• Compliance SWIFT Payments & Accounts Screening I.T Tools.
• Review and formulate policies and procedures for the Compliance Department for continuous improvement.
• Ensure a robust compliance framework and to implement compliance policies and procedures effectively and efficiently.
• Provide compliance advisory support to the bank management and department heads in the discharge of their compliance duties.
• Review manuals of all the other departments and keep all the manuals in accordance with the company's compliance requirements.
• Work closely with the internal and external auditors on regulatory and compliance affairs.
• Manage and coach staff in the department and act as mentor for any new colleagues and trainees.
• Ensure strict regulatory compliance by reviewing the bank's activities. Prepare compliance reports to the management.
• Responsible for implementing antimony laundering and countering terrorist financing measures and reporting of suspicious transactions to the appropriate authorities in consultation with bank management.
Job requirements
As a minimum qualification, the incumbent must be a graduate of a recognized university, holding a bachelor’s degree in Economics, Accounting, Finance, Law, Business Administration, or Islamic Economics, or be a member of ACCA.
Having ACAMS certification is mandatory.
The incumbent must have a minimum of three (3) years of relevant experience in the banking sector at the Chief level, or at least at the Deputy Chief or Senior Manager level in Audit, Risk, or Compliance. Alternatively, the incumbent must have at least five (5) years of relevant experience at the Chief, Deputy Chief, or Senior Manager level in reputable financial institutions, with experience commensurate with the position of Chief Compliance Officer.
The incumbent should have attended some senior management courses and must be fully aware about internationally recognized general banking procedures and practices.
The incumbent must possess the qualities of a team leader and should have a profile and experience of varied working environments.
